Article 1 – Scope

The following Terms and Conditions apply to all orders placed through our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

An entrepreneur is a natural or legal person, or a legal partnership, who, when concluding a legal transaction, acts in the exercise of their trade or profession.

For entrepreneurs: If the entrepreneur uses conflicting or supplementary General Terms and Conditions, their validity is hereby rejected. They shall only become part of the contract if we have expressly agreed to them.


Article 2 – Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Baby Kids B.V.

The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalogue.

You may place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process.

By clicking the order button, you submit a binding offer for the goods contained in the shopping cart.

Confirmation of receipt of your order will be sent by email immediately after the order has been submitted.

We accept your offer within two days by either:

  • sending a declaration of acceptance in a separate email; or
  • arranging the dispatch of the goods; or
  • having the payment transaction processed by our service provider or the selected payment service provider.

The time at which the payment transaction is carried out depends on the payment method selected (see Article 5 – Payment).

The relevant alternative is the one that occurs first.


Article 3 – Contract Language, Storage of Contract Text

The following languages are available for concluding the contract:

  • German
  • English
  • Dutch

The contract text is not stored by us.


Article 4 – Delivery Conditions

In addition to the stated product prices, shipping costs may apply.

Further details regarding shipping costs, if applicable, are provided together with the respective offers.

We deliver to the address specified during the ordering process.

We only deliver via shipping.

Collection of the goods by the customer is unfortunately not possible.

We do not deliver to parcel stations.


Article 5 – Payment

The following payment methods are generally available in our shop:

Credit Card

By submitting the order, you provide your credit card details.

Your card will be charged immediately after placing the order.

PayPal / PayPal Express

To pay via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, identify yourself with your login credentials, and confirm the payment instruction.

The payment transaction will be executed immediately after placing the order.

Further information will be provided during the ordering process.

PayPal may offer additional payment options in the customer account to registered and selected customers.

We have no influence over the availability of these options.

These additional payment methods concern only your legal relationship with PayPal.

Sofort by Klarna

To pay via Sofort GmbH, Theresienhöhe 12, 80339 Munich, Germany, you must have an online banking-enabled bank account, authenticate yourself accordingly, and confirm the payment instruction.

Your account will be debited immediately after placing the order.

Klarna

In cooperation with Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options (available only to consumers):

Klarna Invoice

The invoice amount is due 30 days after shipment of the goods and receipt of the invoice.

Klarna Direct Debit

You grant Klarna a SEPA direct debit mandate.

Klarna will inform you of the debit date in advance (prenotification).

Your account will be charged after the goods have been shipped.

Payment via Klarna requires a successful address and credit check and is made directly to Klarna.

Amazon Payments

Payment processing is carried out via Amazon.

You can pay by credit card or direct debit.

On Amazon.de, Amazon also offers monthly invoice payments, financing, iDEAL, Przelewy24, BLIK, and Bancontact.

Accepted Payment Methods

For entrepreneurs: Purchases on account via Amazon Business are subject to the separate terms and conditions of Amazon Business.


Article 6 – Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the withdrawal policy.

Entrepreneurs are not granted a voluntary right of withdrawal.


Article 7 – Retention of Title

The goods remain our property until full payment has been received.

For entrepreneurs: We retain ownership of the goods until all claims arising from an ongoing business relationship have been settled in full.

Article 8 – Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately.

Failure to submit a complaint or contact us has no consequences for your statutory rights.

However, doing so helps us assert our own claims against the carrier or the transport insurance provider.


Article 9 – Warranty and Guarantees

9.1 Liability for Defects

Unless otherwise expressly agreed below, the statutory provisions regarding liability for defects shall apply.

9.2 Guarantees and Customer Service

Information regarding any additional guarantees and their exact conditions can be found with the respective product and on dedicated information pages within the online shop.

Article 10 – Liability

We shall always be fully liable for claims arising from damages caused by us, our legal representatives, or our agents in the following cases:

  • Injury to life, body, or health;
  • Intentional or grossly negligent breach of duty;
  • Assumed guarantees, where agreed;
  • Cases where liability arises under applicable product liability legislation.

In all other cases, claims for damages are excluded to the extent permitted by law.


Article 11 – Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


Article 12 – Protection of Minors

If your order includes products that are subject to age restrictions, we use a reliable verification procedure to ensure that the purchaser has reached the legally required minimum age.

This verification procedure includes a personal identity and age check.

Products subject to age restrictions will only be handed over personally to the purchaser after successful completion of the age verification process.


Article 13 – Final Provisions

If you are acting as an entrepreneur, German law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The European Data Act gives users of connected products greater control over their data. Below you will find Nanit’s official EU Data Act Disclosure.
